"Modern Family" star Ariel Winter is breaking free from her mom, Crystal Workman, with a little help from her older sister, Shanelle Gray. In October, shocking allegations emerged against Workman, who has reportedly been both physically and emotionally abusive towards her 14-year-old daughter. (Gray filed documents petitioning for guardianship of her younger sibling that month.) According to court papers filed Oct. 3 in Los Angeles, Winter – who plays Alex Dunphy on the hit show – alleges her mother subjected her to "ongoing physical abuse (slapping, hitting, pushing) and emotional abuse (vile name-calling, personal insults about minor and minor's weight, attempts to 'sexualize' minor, deprivation of food, etc.) for an extended period of time." A judge last month granted Ariel's older sister, Shanelle Gray, temporary guardianship and ordered Workman not to contact her daughter until further notice. The mother of 14-year-old Modern Family star Ariel Winter denied Wednesday allegations she abused her daughter, who has a restraining order against her mom and has moved out of the house. "It's all untrue, it's all untrue," Chris Workman says. According to the papers, a judge granted Gray guardianship until a follow-up hearing Nov. 20 and ordered that Workman refrain from contacting Ariel pending further court order.
Shaun White settles charges
Two-time Olympic gold medalist snowboarder Shaun White has reached a deal to settle public intoxication and vandalism charges in Nashville. Susan Niland, the Nashville district attorney's spokeswoman, said White appeared in court Wednesday, a day earlier than scheduled, after he and prosecutors agreed to dismiss charges if he completed alcohol treatment, performed 24 hours of community service and paid restitution.However, the judgment signed in court did not include the alcohol treatment provision. Niland said attorneys have agreed to amend the document Thursday. Police said White pulled a fire alarm in a Nashville hotel at about 2 a.m. on Sept. 16, forcing all guests to evacuate. Jermaine Jackson filed a petition in Los Angeles Nov. 6 to legally change his famous last name to Jacksun. In his filing, Michael Jackson's older brother cites "artistic reasons" for his request to swap the spelling of the last syllable from "son" to "sun." A rep for the singer -- who is currently performing in Europe with brothers Jackie, Marlon and Tito for The Jacksons Unity Tour -- insists to the Associated Press that "phonetically, it changes nothing." "It is something he has chosen to do," he added, quipping, "It's fair to say that you cannot blame this one on the boogie, you've got to blame it on the sunshine," in reference to the Jackson 5's disco hit "Blame It on the Boogie." If nothing else, the vowel swap is generating plenty of publicity for the 57-year-old, who recently released a jazz album and is promoting a book, "You Are Not Alone," a memoir about the late King of Pop. "Nikita," the CW's espionage drama starring Maggie Q, is shifting its time slot back to its original 8 p.m. spot on Friday nights. The show's third season debuted Oct. 19 to record-low ratings, and has been struggling ever since in the 9 p.m. berth following "America's Next Top Model." The season finale for "ANTM" airs Nov. 16, and "Nikita" is expected to take its place Nov. 30. (Holiday specials will air in the intervening week.)

CNN delivered 8.8 million viewers (4.4 adults 25-54) on Tuesday evening. Fox News was right behind with 8.7 million viewers (3.5 million adults 25-54). MSNBC placed third with 4.6 million viewers (2 million adults 25-54). The ratings track from 7 p.m. to 2 a.m., from polls starting to close through Barack Obama’s late-night acceptance speech.

Kim Zolciak wasn't on her best behavior on the Season 5 premiere of "The Real Housewives of Atlanta" -- and she's the first to admit it. But were her rude comments about co-star Kandi Burruss' new home actually racist? "Racist comments! I been telling y'all this 4 a while now," NeNe Leakes tweeted after Kim referred to Kandi's affluent neighborhood as "ghetto" and "hood," and told Kandi of her indoor swimming pool: "Well, you don't need sun, that's perfect for you!" "NeNe constantly insinuated 'I come from a trailer park and I am the racist one?" asks Kim in her Bravo blog. "I don't have to prove anything to anyone. I know my character, and the multiple friends of different races that I do have know it as well! "Like I have said before and will say here again for the last time, COLOR means absolutely nothing to me," she continues. "It is the person's character and blatant ignorance that determines the non-friendship between me and the person." Kim admits she "wasn't in the best mood" after she and her assistant, Sweetie, to see Kandi's new home. "It was over 95 degrees outside, I was 7 months pregnant, and Kandi's home had no A.C. running. Sweetie told me it wasn't safe at all (however I still went to support Kandi), and in fact there are several movies and songs that describe and portray the harshness of that area. As for the swimming pool comment, Kim insists it was "a silly joke," not a racial slur. "My comment about her having an indoor swimming pool because she's black was just a silly joke. Kandi, Sweetie, and I laughed. Quite frankly, I wish I had one myself." Kandi may have laughed at the time, but she later blogged that she was "offended" and "irritated" by Kim's " ghetto neighborhood comments." "In my opinion," writes Kandi, "the stuff that Sweetie says to Kim adds to the whole racist theory people have about Kim."
