Jean Stapleton Dies at 90 Jean Stapleton, the versatile actress who will forever be remembered for her long-running role as the dim-witted but deep-hearted Edith Bunker on the groundbreaking 1970s sitcom All in the Family, died Friday at her home in New York City, her family confirms. Stapleton, who was 90, succumbed to natural causes. Having already established a career during the 1950s and early '60s for playing nosy neighbor roles in such Broadway smashes as Damn Yankees, Funny Girl and Bells Are Ringing, in which she played the owner of the titular answering service. It was also during the stage run of Bells Are Ringing, in 1957, that Stapleton met and married William Putch, a concert promoter who also ran the 453-seat Totem Pole Playhouse summer stock theater in Pennsylvania – where, for the next quarter century, even at the height of her TV stardom, Stapleton would appear. Stapleton entered the TV pantheon with her high-pitched comic voice (which was a gross exaggeration of her own), perfect timing (especially when Edith would be slow to catch on to something) and unrelenting love for her husband Archie Bunker (even while overlooking his bigotry, which she never shared). Winning three Emmys for the role, Stapleton played Edith to Carroll O'Conner's Archie from 1971-79, then asked to be written out of the show as the series continued under slightly different formats. Once she left All in the Family she continued to make TV appearances, such as when in 1996, as if to counteract her trod-upon Edith persona, she played the imperious sister of Doris Roberts's character on Everybody Loves Raymond. She also appeared in the movies Michael and You've Got Mail, and returned to her stage roots, touring in a critically acclaimed one-woman show about Eleanor Roosevelt – a real-life role she had also played in the 1982 CBS movie Eleanor: First Lady of the World. Bill Putsch, with whom Stapleton had two children, Pam and John, died in 1983.

Court OKs lawsuit against Oprah Winfrey's use of 'own your power'
It may truly be empowering to "Own Your Power," but an appellate court panel said Friday that Oprah Winfrey, her Harpo Productions and the Hearst Corp. can be sued by a motivational speaker and radio-show host who claims the line violated her trademark and was illegally used on an "O" magazine cover and a related event. A three-judge panel of the 2nd Circuit Court of Appeals overturned a lower court's decision that said the use of the line amounted to "fair use" and threw out claims made by Simone Kelly-Brown against Winfrey, Hearst, as well as corporate sponsors of the event. The appellate court ordered the lower court to reconsider the case, in which Kelly-Brown sought an injunction to stop Winfrey's use of the phrase. The case stems from the prominent use of the line on the front cover of the October 2010 issue of O. "Own Your Power," touted the cover, which featured the requisite photo of Winfrey and the secondary headline: "How to Tap into Your Strength, Focus Your Energy, Let Your Best Shine." One of the stories in the edition was about "The 2010 O Power List: 20 Women Who Are Rocking the World." The issue was promoted in a Sept. 16 New York event called "Own Your Power," which was then featured in the December edition of the magazine and identified as the "first-ever own your power event." Kelly-Brown, who registered "Own Your Power" as a blue and white trademark in May 2008, sued, arguing both that the magazine's use of the line -- though in a different typeface, different color and different capitalization -- represented an attempt to seize her trademark and confused people.MShe argued that the confusion was detrimental to her brand, and she fielded numerous inquiries from people who were confused between her events and Winfrey's. While judges were unanimous Friday in overturning the lower-court opinion dismissing Kelly-Brown's suit, they offered two sets of reasoning.

ANNA NICOLE'S ESTATE WINS MILLIONS IN SANCTIONS
The daughter of late model Anna Nicole Smith, Dannielynn, could be awarded as much as $49 million in sanctions per court orders from the estate of E. Pierce Marshall, the son of Anna Nicole's once-husband J. Howard Marshall. a California federal judge has ordered Marshall's estate to "pay sanctions over 'massive discovery abuse' in the Koch Industries heir's scorched-earth legal battle against his stepmother, the late 'Playboy' model Anna Nicole Smith." For over a decade, Smith's estate has been attempting to recover hundreds of millions of dollars from the estate of her husband J. Howard Marshall, who died in 1995 at the age of 90, a year after he married the then-26-year-old model. The sanctions against the estate of E. Pierce Marshall, who passed away in 2006, were issued due to his alleged attempts to delay the transfer of wealth to Smith's estate, including purportedly "shipping crucial legal documents to a lawyer in Lake Charles, La. to try and keep them out of the hands of Smith's lawyers." the judge didn't specify the monetary amount of damages, but suggested last March that it could reach up to $49 million. "This is a complete vindication of Anna Nicole's rights, and a total condemnation of what was done to her," Phil Boesch, lawyer of Smith's estate, told Forbes. "We are confident that the amount Anna's estate and daughter Dannielynn will finally be awarded will be fair and substantial."
